These Terms of Service (“Terms”) govern your access to and use of Pookie CA (the “Service”), including the website at pookieca.com, the Pookie CA mobile application, and the Pookie CA Telegram bot and Mini App (collectively, the “Platform”), operated by Pookie CA (“we”, “us”, “our”).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 16 years of age to use the Platform. If you are under 18, you may use the Platform only with the consent and supervision of a parent or legal guardian. By using the Platform, you represent that you meet these eligibility requirements.

The Platform is intended for users preparing for examinations administered by the Institute of Chartered Accountants of India (“ICAI”). It is not designed for, nor a substitute for, formal coaching, professional advice, or official ICAI materials.

2. Service description

Pookie CA provides:

  • Access to multiple-choice questions (“MCQs”) based on the ICAI syllabus
  • Step-by-step solutions and explanations to those MCQs
  • Practice tracking and progress analytics
  • Access via the website, mobile application, and Telegram bot
  • Free tier with daily usage limits
  • Paid tiers offering expanded access for fixed durations
  • Marketing content, including past paper analyses, study guides, and notes

We do not represent ourselves as affiliated with, endorsed by, or partnered with the ICAI. All references to ICAI publications, syllabus, and standards are for educational reference only. The ICAI is the sole authority on its examinations.

3. Account registration

To access certain features of the Platform, you may be required to create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your authentication credentials
  • Accept responsibility for all activity that occurs under your account
  • Notify us immediately of any unauthorised use of your account

We support the following authentication methods:

  • Telegram identity (via Telegram’s authentication)
  • WhatsApp one-time-password (OTP)
  • Google account (via Google Sign-In)

We do not collect or store passwords. Account access is governed by the respective authentication provider’s policies.

4. Subscriptions, payments, and packs

4.1 Payment processor

All payments are processed by Razorpay Software Private Limited, a Reserve Bank of India (“RBI”) authorised payment aggregator. We do not store your full payment card details, UPI virtual payment address, or banking credentials. By making a payment, you also agree to Razorpay’s terms of service and privacy policy.

4.2 Pricing and currencies

All prices are displayed in Indian Rupees (INR / ₹) inclusive of applicable taxes unless otherwise stated. We reserve the right to change pricing at any time. Changes apply prospectively only and will not affect previously completed purchases.

4.3 Pack purchases (one-time)

Pack purchases (such as single-chapter unlocks, half-subject unlocks, or full-subject unlocks) provide time-limited access to specified content for the duration stated at the time of purchase (typically 180 days from purchase). The access window begins from the date of purchase confirmation, not from first use.

Pack purchases are non-recurring and do not auto-renew. To extend access after expiry, a new purchase is required.

4.4 Subscriptions (recurring)

Subscription plans, where offered, provide ongoing access on a recurring basis (monthly, quarterly, or annual). Subscriptions auto-renew at the end of each billing period using the payment method (typically UPI AutoPay or card mandate) registered at signup, unless cancelled before the renewal date.

You may cancel a subscription at any time from your account dashboard at app.pookieca.com. Cancellation prevents future renewals but does not retroactively refund the current billing period.

4.5 Refunds

Refunds policy: see our separate Refund Policy at pookieca.com/refund-policy. By making any purchase, you acknowledge that you have read and accepted that policy.

5. Content and intellectual property

5.1 Our content

The Platform contains study materials, MCQs, solutions, summaries, illustrations, software, and other content (the “Content”). All Content is owned by Pookie CA or licensed to us, and is protected by Indian and international copyright, trademark, and other intellectual property laws.

You are granted a personal, non-exclusive, non-transferable, revocable licence to access and use the Content solely for your own examination preparation. You may not:

  • Reproduce, distribute, publish, or display the Content publicly
  • Sell, sublicense, or commercially exploit the Content
  • Use automated tools (bots, scrapers, scripts) to extract Content
  • Share your account credentials or paid access with any other person
  • Use the Content to train any machine-learning model or to build a competing product
  • Remove or alter any copyright, trademark, or proprietary notices

Content sourced from ICAI publications is reproduced for educational reference under fair use and remains the property of the ICAI.

5.2 User-submitted content

If you submit feedback, suggestions, doubts, error reports, or other content to us (collectively, “Feedback”), you grant us a perpetual, irrevocable, royalty-free, worldwide licence to use, modify, and incorporate that Feedback into the Platform without compensation. Feedback should not contain any personal, sensitive, or third-party information.

6. Acceptable use

You agree NOT to:

  • Use the Platform for any unlawful purpose
  • Attempt to gain unauthorised access to any part of the Platform, other users’ accounts, or our systems
  • Interfere with, disrupt, or circumvent any security or rate-limiting measures
  • Use the Platform to harass, defame, or harm any person
  • Upload or transmit viruses, malware, or other harmful code
  • Engage in any activity that imposes unreasonable load on our infrastructure
  • Misrepresent your identity or impersonate any person
  • Resell, transfer, or trade access to any paid features

Violation may result in suspension or termination of your account without notice and without refund.

7. Third-party services

The Platform integrates with third-party services including but not limited to:

  • Telegram (Telegram FZ-LLC) — for the bot and Mini App
  • Razorpay (Razorpay Software Private Limited) — for payment processing
  • Cloudflare (Cloudflare, Inc.) — for hosting and edge infrastructure
  • Supabase (Supabase, Inc.) — for backend data services
  • Brevo (Sendinblue SAS) — for transactional email and messaging
  • Google (Google LLC) — for OAuth sign-in
  • Vercel (Vercel Inc.) — for application hosting

Use of these third-party services is governed by their respective terms and privacy policies. We are not responsible for the content, availability, or practices of third-party services.

8. Disclaimers

THE PLATFORM AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

We do not warrant that:

  • The Platform will be uninterrupted, error-free, or secure
  • Defects will be corrected
  • The Content is accurate, complete, current, or free from typographical or other errors
  • Use of the Platform will result in any particular examination outcome
  • The Platform will meet your specific requirements or expectations

You acknowledge that examination performance depends on many factors beyond practice MCQ access. Pookie CA is a supplementary tool, not a guarantee of any examination result.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, POOKIE CA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR EXAMINATION OUTCOMES, ARISING FROM OR RELATED TO YOUR USE OF THE PLATFORM.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIM ARISING UNDER OR IN CONNECTION WITH THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ₹500 (FIVE HUNDRED RUPEES), WHICHEVER IS HIGHER.

These limitations apply regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and apply even if we have been advised of the possibility of such damages.

10. Indemnity

You agree to indemnify, defend, and hold harmless Pookie CA, its officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your use of or access to the Platform
  • Your violation of these Terms
  • Your violation of any third-party rights, including intellectual property or privacy rights
  • Any Content you submit, post, or transmit through the Platform

11. Termination

We may suspend or terminate your access to the Platform, with or without notice and with or without cause, including for violation of these Terms. Upon termination:

  • Your right to access the Platform ceases immediately
  • Any active paid access (packs or subscriptions) is forfeited without refund
  • Provisions of these Terms that by their nature should survive termination (including ownership, disclaimers, limitations of liability, and dispute resolution) will continue to apply

You may stop using the Platform at any time. If you have an active subscription, cancellation must be initiated through your account dashboard.

12. Governing law and dispute resolution

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles.

Any dispute arising out of or in connection with these Terms shall be resolved exclusively in the courts of [JURISDICTION TO BE INSERTED — typically the city where the business is registered, e.g., “Bengaluru, Karnataka”].

Before commencing any formal legal proceedings, the parties agree to attempt good-faith resolution by contacting us at support@pookieca.com.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email or by prominent notice on the Platform at least 7 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

The “Last Updated” date at the top of this document reflects the most recent revision.
